Terms of Service

These Terms of Service ("Terms") govern your use of the Shaksthetics platform (the "Service") operated by Shaksthetics LLC ("Shaksthetics", "we", "us", or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Shaksthetics provides personalised online fitness coaching, including custom training programmes, nutrition guidance, and weekly check-ins delivered through our web platform. The Service is intended for adults aged 18 and over.

The coaching content provided is for informational and educational purposes. It is not a substitute for professional medical advice. Consult a qualified healthcare provider before starting any new exercise or nutrition programme, especially if you have an existing medical condition or injury.

You must create an account to access the Service. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate information and keep it up to date. You may not share your account with anyone else.

We reserve the right to suspend or terminate accounts that provide false information, violate these Terms, or are used for fraudulent activity.

Trial period

New accounts receive a 7-day free trial. Your payment method is collected at sign-up but you will not be charged until the trial ends. You may cancel at any time during the trial at no cost.

Recurring subscription

After the trial, the Service is billed at $50 per week via Stripe, charged automatically to the payment method on file. Billing continues until you cancel.

Cancellation

You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the current billing period — you retain access through that date. We do not offer partial-week refunds.

Pause

You may pause your subscription for up to 8 weeks per calendar year. Pausing stops billing and programme updates for the pause period. Contact us at shaksthetics@gmail.com to request a pause.

Price changes

We will give at least 14 days' notice of any price change by email and via an in-app notice. Continued use after the effective date constitutes acceptance of the new price.

You agree not to:

• Use the Service for any unlawful purpose.
• Share, resell, or redistribute coaching content or programme materials without written permission.
• Attempt to gain unauthorised access to any part of the platform or another user's account.
• Interfere with or disrupt the platform's infrastructure.
• Submit false or misleading information that could affect the quality of your programme.

All coaching content, programme materials, written guides, and platform software are the intellectual property of Shaksthetics LLC and are protected by copyright. You are granted a limited, non-exclusive, non-transferable licence to access and use the content for your personal, non-commercial fitness purposes only.

Exercise involves inherent risk of injury. By using the Service you acknowledge that you are voluntarily participating in a fitness programme and assume all risk of injury. Shaksthetics is not liable for any injury, illness, or adverse health event arising from your use of the Service.

If you experience chest pain, dizziness, shortness of breath, or any other serious symptom during exercise, stop immediately and seek medical attention.

To the maximum extent permitted by applicable law, Shaksthetics LLC and its owners, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the Service, even if advised of the possibility of such damages.

Our total liability for any claim arising under these Terms shall not exceed the amount you paid to us in the 30 days preceding the claim.

You agree to indemnify and hold harmless Shaksthetics LLC from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

We may suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, or any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.

These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict of law principles. Any dispute arising from these Terms shall be resolved exclusively in the state or federal courts located in Fulton County, Georgia.

We may update these Terms from time to time. We will notify you of material changes by email and by updating the effective date at the top of this page. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
